Date: | March 17, 2000 | Subject: | PROCEDURES TO BE FOLLOWED IN APPLYING THE NEW RULES RELATIVE TO CERTIFICATION OF COMPLETION OF WORK AFTER THE ISSUANCE OF A TEMPORARY USE PERMIT AND COLLECTION OF FEES FOR MISSED APPOINTMENTS, TEMPORARY USE PERMIT RENEWALS AND PRE-INSPECTION CLEARANCE REQUESTS | Effective: | May 1, 2000 | Purpose: | To establish procedures to be applied to give effect to the newly promulgated Rules 11-05 and 11-06 of Chapter 11, Title 1 of the Rules of the City of New York. | Specifics: | - SELF-CERTIFICATION OF ELEVATOR APPLICATIONS.
Where the Department has issued a temporary use permit, a certified elevator inspection agency director, professional engineer or registered architect may certify to the Department that the outstanding work (Punch List) needed to be performed prior to the issuance of a Final Certificate of Operation has been completed in conformity with the requirements of Subchapter 18 of Chapter 1 of Title 27 and Reference Standard 18-1. The affidavit of professional certification form #ELV-20 (8/99) must be completed and a copy of the last issued temporary use permit and last issued punch list must be attached to said certification. The certification must be dated and the appropriate license number and seal where applicable must be included. Upon proper submission of form #ELV-20 (8/99) and its required attachments, a final use permit may be issued for said device. If only one device is involved in said application, then a B-73 sign-off may be issued. For multiple device applications, a single affidavit of professional certification for the devices may be submitted provided that copies of the last issued temporary use permit and punch list for each device referenced on the affidavit is included in the submission. - RENEWAL OF TEMPORARY USE PERMITS
A temporary use permit issued pursuant to 27-188 of the Administrative Code may be renewed by submitting a properly completed, signed and dated renewal application, form #ELV-21 (8/99). PLEASE NOTE: The temporary use permits are automatically renewed every 30 days up to 120 days from the date of issuance. After 120 days the renewal application must be submitted along with a copy of the last issued temporary use permit and a check for $100 for each device. After the renewal application has been reviewed and approved by the Elevator Division, a copy of the approved application along with the $100 check must be paid to the cashier. The applicant must present the approved application and the cashier's receipt for the $100 to the Elevator Division before a temporary use permit renewal will be issued for that device. The cashier's receipt must indicate that it is for the payment of a temporary use permit renewal. - FEE FOR UNPREPARED SCHEDULED TEST
Where a Department inspector arrives at the site of a scheduled inspection or test and is unable to perform the scheduled inspection or witness the test because the owner or its representative has failed to keep or is unprepared for the appointment, a fee of $200 will be imposed. This fee must be paid before scheduling any new appointment for this application. - The inspector involved in the missed field appointment must place a notation on the application appointment sheet, describing the reason for the missed appointment and have a representative of the company, if one is present, sign next to this notation acknowledging or disputing the notation. Next the inspector must immediately call the office and report the missed appointment to the Chief.
- The Chief must record all the necessary information from the inspector, complete a "Missed Appointment Notice", form #ELV-23 (8/99) and see that this notice is placed in the application folder and that a copy of the notice is mailed to the owner listed on the application.
- In addition, the address and application number involved in this missed appointment must be included on a list that will be maintained at each of the chiefs' and the appointment clerks' desks and updated weekly to prevent the rescheduling of any appointments prior to the payment of the required fee. The chiefs and the appointment clerks must consult this list prior to scheduling any appointments.
- If an appointment is requested when a fee is due, the applicant must be notified immediately that the appointment will not be honored without payment of the missed appointment fee.
- The Deputy Director of the Elevator Division shall maintain strict auditing review of the maintenance of this list of "missed appointments" by periodically reviewing the appointment books and ensuring that no applicant with an outstanding missed appointment fee is afforded a rescheduled appointment.
- No further appointment may be arranged for any application, which has a missed appointment and an unpaid fee for the missed appointment. Prior to scheduling any subsequent appointment, a receipt for payment of the fee must be in the application folder. The receipt from the cashier must clearly indicate that the payment is for the missed appointment on a specific application.
- PRE-INSPECTION CLEARANCE
An owner or authorized agent may, on short notice, request that an appointment for an application inspection be scheduled. This request must be submitted in person, and must be on a properly completed Pre-Inspection Clearance Form #ELV-22 (8/99). It must also be accompanied by a cashier's receipt for the payment of the nonrefundable fee of $200 per device. The receipt must indicate that it is a receipt for payment of the pre-inspection clearance on a specific application. That information can be taken by the cashier from the request form. In order to accommodate these requests, the Department reserves its right to schedule the requested appointment during non-regular off-peak hours.
