NYC Housing Connect Terms and Conditions of Use for Applicants and Account Holders

Welcome to New York City’s Housing Connect Portal (“NYC Housing Connect”).

Please read the following Terms of Use (“Terms”) carefully before creating your NYC Housing Connect account and submitting your documents to be reviewed for eligibility for an affordable housing lottery.

NYC Housing Connect and Housing Lotteries:

  1. NYC Housing Connect is provided by the City of New York (“City” or “NYC”) through the NYC Department of Housing Preservation and Development (“HPD”) and the New York City Housing Development Corporation (“HDC”) to help you find and apply for affordable housing opportunities in New York City.
  2. HPD and/or HDC do not own or operate the affordable housing units (“units”) offered through NYC Housing Connect. The units are owned by private entities and HPD and/or HDC are not responsible for the habitability, rent, or sales price of any unit offered through NYC Housing Connect.
  3. HPD and/or HDC do not administer the housing lotteries or lease up or sell the units made available through NYC Housing Connect.  

    Your NYC Housing Connect Profile:
     
  4. You must be at least 18 years old or an emancipated minor to sign a lease for or purchase a unit in New York City. By agreeing to these Terms, you represent that you will be able to provide proof that you are over 18 years old or are emancipated.
  5. By creating a NYC Housing Connect account, you consent to receiving communications through your account from HPD and/or HDC. You may receive communications from other NYC agencies also, subject to the restrictions set forth in NYC’s Privacy Policy.
  6. During account creation, you may opt to receive communications about your account through text message. If you select this option, you may be charged a fee by your wireless carrier, depending on the messaging and data plan to which you subscribe. None of the City, HPD, and/or HDC will charge you any fee for selecting the text communication option.
  7. NYC Housing Connect uses third-party services for translation services and address validation. If your address is not accepted in the application, you will be given an option to request assistance to resolve the issue. HPD and/or HDC is not responsible for any errors in translation services or address validation. 

    Your applications to housing lotteries:
     
  8. Using your NYC Housing Connect profile to apply for a housing lottery does not mean that you will receive a unit. When you apply for a housing lottery, you are only entering your profile into the pool of applications for that lottery.
  9. Information that you submit and documents that you upload to NYC Housing Connect through your profile will be used by developers, owners and sponsors of Projects (“Developers”) and marketing agents employed by Developers (collectively “Marketing Agents”) to evaluate your eligibility for the housing lotteries to which you apply.
  10. Marketing Agents are required to retain copies of your application and uploaded documents in accordance with the HPD and HDC Marketing Handbook (as may be amended from time to time).
  11. If your log number is reached for a lottery to which you applied, the Marketing Agent will decide if you are eligible for a unit based on the information in your profile at the time of its review. If there are any changes to your income, household size, or household’s information after you create the profile, you must update your NYC Housing Connect profile immediately to ensure the Marketing Agent reviews your updated information.
  12. Marketing Agents administer the housing lotteries advertised through NYC Housing Connect. Marketing Agents will determine which applicants qualify for a particular Project. In making that determination, the Marketing Agents must follow the HPD and HDC Marketing Handbook.  

    Misuse of NYC Housing Connect:
     
  13. You may submit only one application per lottery. If you have submitted multiple applications, your application may be rejected or you may be assigned the least advantageous log number of the applications you submitted.
  14. You may not submit an application to any housing opportunity for a building owned by you or your immediate family member, or if you are employed by the Developers or any of its agents. If you do so, your application to that lottery will be rejected, or your lease for an affordable unit obtained through that lottery will be terminated (if your relation to the building’s owner is discovered after lease signing), and HPD and/or HDC may refer your application to the appropriate enforcement authorities.
  15. By creating an account, you agree that you will not engage in inappropriate or abusive behavior and communications using NYC Housing Connect, or falsify information in your profile, or submit fraudulent documents to support your profile. HPD and/or HDC reserves the right to take appropriate action, up to and including termination of your account and referral to appropriate enforcement authorities, if you engage in such conduct.
  16. Neither HPD nor HDC controls the information you may post on NYC Housing Connect. Each of HPD and HDC expressly disclaims any liability to you if any of such information should be lost, misplaced, compromised or otherwise misused by Developers, Marketing Agents or other third parties.

These Terms (which may be amended by HPD or HDC from time to time in their sole discretion), together with the NYC Privacy Policy, the NYC Terms of Use, and the HDC Privacy Policy constitute the entire agreement between you, the City, and HDC with respect to your use of NYC Housing Connect.
