Residential Waste Management Plans

Certain new large residential developments are required to submit Waste Management Plans to DSNY at the same time they submit plans that include design drawings to the NYC Department of Buildings (DOB). This rule went into effect on April 1, 2022.

Building Projects that Must Submit a Plan

You must submit a plan if your project meets the following requirements:

Project Types

  • New residential building containing 150 or more dwelling units;
  • Existing residential building where alterations increases the amount of floor surface area by more than 110% over the amount of existing floor surface area
  • Commercial building that is modified to be classified by DOB as a multiple dwelling building containing 150 or more dwelling units;
  • Commercial building with 50% or more of its floor area renovated to be classified by DOB as a multiple dwelling building containing 150 or more dwelling units.

Project Stage

  • Design drawings have been submitted to the DOB on or after the effective date of this rule (April 1st, 2022)
  • Design drawings have been submitted to DOB, but have not been approved by DOB as of the effective date of this rule (April 1st, 2022)

Timeline

Waste management plans are due at the same time as plans that include design drawings are submitted to the NYC Department of Buildings.

  • Design drawings have been submitted to the DOB on or after the effective date of this rule (April 1st, 2022)
  • Design drawings have been submitted to DOB, but have not been approved by DOB as of the effective date of this rule (April 1st, 2022)

Plan Review Period

  • We have 90 days to review the plan from the time of submission
  • If your plan is rejected, We will provide details of the plan's deficiency
    • Applicant will have 60 days to resubmit an amended plan
    • We will have 90 days from the date of amended plan submission to review and make a final determination

NOTE: We require applicant to schedule a consultation to ensure your plan is complete and meets the required specifications.

Final Determination

We may deny collection service to any building that:

  • Obtains a Certificate of Occupancy from DOB prior to having a DSNY-approved waste management plan
  • Fails to submit a waste management plan in accordance with this rule
  • Fails to certify that an approved waste management plan has been properly implemented

Our authority for these rules is found in section 753 of the New York City Charter and section 16-120 of the New York City Administrative Code.
