Follow-up #1: In-Person Appointments for Standard Plan Examination Job Filings on Wednesdays Only
Beginning January 2024, to attend an in-person appointment with a plan examiner in the Bronx, Brooklyn, Queens, or Staten Island borough offices, schedule the appointment for a Wednesday.

Local Law 149 of 2021: Construction Superintendents are Limited to Three Jobs
Beginning January 2, 2024, the Department of Buildings will not issue a permit if the Construction Superintendent (CS) designated on the permit application is already designated on 3 or more active permits.

Local Law 154 of 2021: On-site Fossil Fuel Combustion Limitations
Beginning January 1, 2024, New Buildings and New Buildings with Existing Elements to Remain – as described in NYC Administrative Code Section 28-101.4.5 – that are less than 7- stories (except for on-site fossil fuel combustion for service hot water) or classified as Group R-3 (one- and two-family homes), will be required to comply with Local Law 154 of 2021.

2022 Construction Codes: Civil Penalty for Failure to Obey a Vacate Order
Beginning December 15, 2023, the Department of Buildings will impose an additional civil penalty when a violation for a failure to obey a Vacate Order is issued. In addition to correcting the condition that resulted in the Vacate Order, the civil penalty must be paid before the Vacate Order is lifted. See NYC Administrative Code §28-207.4.3.

Buildings After Hours 2024 Schedule Released
The 2024 dates for Buildings After Hours have been scheduled to occur the first and third Tuesday of each month from 4:00 pm to 7:00 pm. If the Tuesday falls on a government holiday, Buildings After Hours will be cancelled.

Worker/Contractor Shed Filings in DOB NOW: Build
Beginning December 15, 2023, filings for worker sheds, contractor sheds, contractor offices, and similar structures (see Building Code 3303.16) will be submitted in DOB NOW: Build.

Follow-up #1: Interim Process for CCD1 Requests, ZRD1 Requests, and Requests for Second Review of Plan Examination Objections that cannot be submitted in DOB NOW
The below requests currently cannot be submitted in DOB NOW. Submit second review of objection on an AI1 form by email to the borough office. Submit CCD1s and ZRD1s by email to the borough office and make payments in person at the cashier.

Class 1 and Class 2 Filing Representative Registrations Will Be Issued and Renewed Without Proof of Training Completion Until Training is Available
The Department-approved training courses required to obtain and renew Class 1 and Class 2 Filing Representative registrations are not currently available. The Department of Buildings will continue to issue and renew Class 1 and Class 2 Filing Representative registrations without the required DOB-approved training course if the applicant submits a signed and notarized Class 1/Class 2 Filing Representative Future Completion of Training Courses Affidavit agreeing to take the course and submit proof of completion no later than 6 months after the course becomes available.

Follow-up #2: 2022 Construction Codes: Fee Changes for LNO/LOV, OP 128 and Temporary Use Letters
Beginning December 4, 2023, the Department will institute fee changes, pursuant to §28-112.8 of the NYC Administrative Code, for the following: Letter of No Objection (LNO)/Letter of Verification, the OP 128: Ordinary Plumbing Work Report, and temporary use letter renewals.

Violations for 2018-2022 Failure to File Affirmation of Correction for Boiler Inspection Report
The Department will issue violations in November 2023 for failure to file an affirmation of correction for defects reported on the high- and low-pressure boiler inspection report in the years 2018, 2019, 2020, 2021, and 2022.

REQUIREMENT: Annual Parapet Observation
Beginning January 1, 2024, owners of buildings with parapets fronting the public right-of-way (a public street, avenue, sidewalk, roadway or any other public place or public way), regardless of height, are required to have an annual observation of the building’s parapet performed. See NYC Administrative Code §28-301.1.1 and Title 1 of the Rules of the City of New York §103-15.

DOB NOW: Build to Launch Suspended Scaffold Work Type
Beginning November 15, 2023, all new Suspended Scaffold filings will be required to be submitted in DOB NOW: Build. This applies to applications that are currently submitted using either the CD5 or PW1 form.

DOB NOW: Build to Launch Solar and Green Roof Filing Submittal
Beginning November 15, 2023, all new Solar and Green Roof filings will be required to be submitted by a Professional Engineer or Registered Architect in DOB NOW: Build. Solar and Green Roof filings will not be accepted in BIS after November 15, 2023.

Electric Energy Storage Equipment Work Type to Launch in DOB NOW: Build
Beginning November 15, 2023, Electric Energy Storage Equipment (EESE) filings will be required to be submitted by a Professional Engineer or Registered Architect in DOB NOW: Build.

Follow up #1: Local Law 163 of 2021: Artwork on Temporary Protective Structures
Beginning October 27, 2023, owners who answer ‘Yes’ to question 11 on the PW1 for a sidewalk shed, construction fence, or supported scaffold in DOB NOW will be required to provide the reason for opting out of the requirement to display approved artwork on the temporary protective structure.

Civil Penalty Waiver Requests for Boilers and Elevators in DOB NOW: Safety
Beginning October 27, 2023, the Civil Penalty Waiver Request Reasons for elevator violations, and violations for high-pressure and low-pressure boilers will be updated in DOB NOW: Safety to reflect changes to Title 1 of the Rules of the City of New York Sections 103-01, 103-02, and 103-05.

Violations for 2018-2022 Failure to File Affirmation of Correction for Category 1 Elevator Test Report
The Department of Buildings will issue violations in October 2023 failure to file an affirmation of correction for defects reported on the Category 1 elevator test report in years 2018, 2019, 2020, 2021, and 2022.

Special Inspections: Implementing Requirements for Inspections Introduced in the 2022 NYC Construction Codes
Beginning November 8, 2023, registration and accreditation requirements will be implemented as prescribed in Buildings Bulletin 2022-014, Sections III.B and III.D, respectively. The new requirements address revisions to 1 RCNY 101-06, effective July 13, 2023, which establish inspector qualifications for special inspections introduced in the 2022 NYC Construction Codes.

June 2010 Work Without a Permit: Requesting an Override, Reduction, or Waiver of Civil Penalties
Effective October 16, 2023, only the revised L2 forms dated 9/2023 will be accepted for review.

Energy Storage Systems Applications: Updated Filing Requirements for OTCR Site-Specific Evaluation
Updated Energy Storage Systems (ESS) filing requirements are issued by
DOB’s Office of Technical Certification & Research (OTCR) for site-specific
evaluations and will take effect October 16, 2023.

Building Owners Required to Post Building Energy Efficiency Rating Label – Local Law 33 of 2018 as amended by Local Law 95 of 2019
No later than October 31, 2023, owners of buildings over 25,000 square feet – or multiple buildings on a lot that total 100,000 square feet or more – that appear on the NYC Benchmarking Covered Building List for Compliance in 2023 must post the Building Energy Efficiency Rating Label that includes the building’s 2022 energy efficiency grade in a conspicuous location near each public entrance to their buildings.

To request a Corner and Angle Scaffold Inspection, please send the new Corner/Angle Scaffold Inspection Request Form as per BC §3314.16.4 to CSCUAppointments@buildings.nyc.gov.

REVISED SCHEDULE: Effective October 2023 Buildings After Hours to Occur the First and Third Tuesday of the Month
Beginning Tuesday, October 3, 2023, Buildings After Hours will occur the first and third Tuesday of the month. If the Tuesday falls on a City government holiday, Buildings After Hours will be cancelled.

Buildings After Hours Cancelled and Limited Office Hours on September 12, 2023
On Tuesday, September 12, 2023, Buildings After Hours is cancelled and there will be limited in-person services from 11:30 am – 4:00 pm at all DOB borough offices.

No Waiver for Sidewalk Shed Work Without a Permit Civil Penalties
Beginning September 1, 2023, the Department of Buildings will no longer waive the Work Without a Permit civil penalty for installed permitted sidewalk sheds with an expired permit. See Title 1 of the Rules of the City of New York Section 102-04(d)(5).

Local Law 163 of 2021: Artwork on Temporary Protective Structures
Local Law 163 of 2021, effective September 1, 2023, requires approved artwork or alternative artwork, as selected by the property owner, to be displayed on temporary protective structures (sidewalk sheds, construction fences, and supported scaffolds that have been installed for 90 days).

Follow up #1: 2022 Construction Codes: Fee Changes in BIS and DOB NOW
The following fee changes in the 2022 Construction Codes are or will be effective in the Buildings Information System (BIS) and DOB NOW:

Local Law 77 of 2023: Post Approval Amendment Fee and License Renewal Applications
Updates have been made in DOB NOW and eFiling to implement provisions of Local Law 77 of 2023.

Follow Up #1: Local Law 158 of 2017 – Exceptions to the Restriction on Professionally Certified Filings
A new exception to the restriction on professional certification has been added by Local Law 77 of 2023. Filings on buildings with LL158/17 Pro Cert Restrictions in the Property Profile can be professionally certified if the work without a permit was issued to a residential part of the building and the proposed work will be performed on the commercial part of the building. (See Administrative Code § 28-104.2.1)

Follow Up #2: Owner Notification of Start of Work
NYC Building Code Section 3303.10.2 has been amended by Local Law 77 of 2023 to require owners to notify the Department of Buildings not less than 24 hours but not more than 72 hours before starting work requiring a Tenant Protection Plan (TPP).

Follow-up #1: Fee and Permit Restriction Waivers for Work to Address Damage Caused by Remnants of Hurricane Ida Expiring on August 31, 2023
Since September 14, 2021, the Department of Buildings has not required applicants to pay fees for filings and permits for work to address damage caused by remnants of Hurricane Ida pursuant to a Mayoral Emergency Executive Order. Permit restrictions have also been waived in connection with such applications.

Fee and permit restriction waivers will expire on August 31, 2023. Filings that were eligible for fee and permit restriction waivers will no longer be eligible for any subsequent filings submitted after August 31, 2023.

Violations for 2018-2022 Failure to File Category 1 Elevator Test Report
The Department of Buildings will issue violations in August 2023 for not filing a category 1 elevator test report in years 2018, 2019, 2020, 2021, and 2022.

Follow-up #1: Local Law 97 of 2019 – Building Emissions Adjustments Applications Deadline Extended
The deadline for submitting applications for NYC Administrative Code §28-320.8 and §28-320.9 adjustments to annual building emissions limits for calendar years 2024-2029 has been extended. (See Local Law 77 of 2023.) Applications for adjustments must be submitted in DOB NOW: Safety.

Violations for 2018-2021 Failure to File Annual Boiler Inspection Reports
The Department of Buildings will issue violations by July 2023 for failure to file an annual boiler inspection report for the years 2018, 2019, 2020, and 2021.

Retaining Wall Flag on Property Profile
A new an LL37/08 Retaining Wall flag has been added to the Buildings Information System (BIS) Property Profile. Properties that have this flag in the Property Profile have retaining walls or parts of retaining walls that are subject to the inspection and reporting requirements in Local Law 37 of 2008 and Section 103-09 of Title 1 of the Rules of the City of New York.

Civil Penalty Increase for Failing to File an Acceptable Certificate of Correction for an Immediately Hazardous Class 1 Summons (AEUHAZ)
The penalty for failure to file a certificate of correction for an Immediately Hazardous Class 1 summons will be increased from $3,000 to $5,000. The increased penalty will apply to summonses issued on or after May 15, 2022, for an immediately hazardous condition at a construction site that is not a one- to four-family home.

Limited Customer Service Office Hours June 8 and 9, 2023
All borough offices will be open to the public from 8:30 am to 12:00 pm only on Thursday, June 8 and Friday, June 9, 2023.

Local Law 109 of 2022: Rodent Abatement During Construction
Effective May 18, 2023, a licensed exterminator is required to treat the premises for rodent extermination, as required by the NYC Department of Health and Mental Hygiene (DOHMH), for the following work:
• Construction work involving 50% or more of the floor area of a building
• Vertical or horizontal enlargement increasing the building floor area by more than 25%
• Demolition of more than 50% of the floor area of a building
• Full demolition of a building.

Local Law 196: Renewing Site Safety Training Cards
Workers and supervisors whose Site Safety Training (SST) cards expire in 2023 must complete site safety training refresher courses before they can renew their cards. Refresher training must be taken no more than one year before applying for card renewal.

New Fees for Site Safety Plan Review
Effective May 27, 2023, the Department of Buildings’ rules have been amended to include fees for site safety plan review. See Title 1 of the Rules of the City of New York Section 101-03.

Effective June 9, 2023, the Cranes & Derricks Unit will be located at 280 Broadway in Manhattan on the 4th Floor.

New Online Payment Methods in DOB NOW
Effective May 21, 2023, DOB NOW payment options will be expanded to include PayPal and Venmo for all transactions.

License Insurance Updates in DOB NOW: BIS Options
Effective June 5, 2023, licensees/registrants are required to submit license insurance updates in DOB NOW: BIS Options. The last day to submit insurance certificates by email is June 1, 2023.

Payment of Outstanding Summonses Required for License Renewal
Effective June 5, 2023, licensees/registrants will not be able to begin a license renewal application in DOB NOW: BIS Options until all outstanding Office of Administrative Trials and Hearings (OATH) summonses are paid.

Small Business Team at Buildings After Hours
DOB’s Small Business Team (SBT) is available during Buildings After Hours every Tuesday from 4:00pm to 7:00pm for small business owners to receive assistance.

New Supersede & Withdrawal functions in DOB NOW: Build
Beginning March 6, 2023, additional supersede and withdrawal functions are available for PW1/PW2 filings in DOB NOW: Build.

Follow-Up #4: Extension of Enforcement Moratorium and Temporary Assistance Program for Certain Business Signs
The moratorium on the issuance of certain accessory sign violations, and the temporary assistance program for certain accessory signs have been extended to February 9, 2025. (see Intro. 886 of 2023) Until that date, the Department of Buildings will not issue violations for business storefront signs that existed before February 9, 2019, are no more than 150 sq. ft. in area or 1,200 pounds, and do not create an imminent threat to public health or safety.

Beginning on March 6, 2023, all new Full Demolition (FD) jobs will be required to be filed in DOB NOW: Build.

Updated Submission Process for CD5: Suspended Scaffold Applications
Effective Tuesday, February 21, 2023, include only one paper set of documents with submission of CD5: Suspended Scaffold Applications. After plan review is complete, digital project drawings will be requested for stamping and will be returned by email.

Local Law 97 of 2019: Updated Building Emissions Limits
The Department of Buildings has established updated emissions limits for buildings required by Title 28 of the NYC Administrative Code, Articles 320 and 321 to have building emissions reports submitted. The new limits are based on the property types in the Environmental Protection Agency’s Energy Star Portfolio Manager (ESPM), rather than the occupancy groups listed in the New York City Building Code. (See 1 RCNY § 103-14.)

Foundation Filings No Longer Require Energy Submissions
Effective January 26, 2023, Foundation (FO) filings in DOB NOW: Build no longer require an Energy Submission. Any prior Energy Submissions in any status have been removed from all FO filings.

Retaining Wall Report Filing Process
Owners of retaining walls that are 10 feet or higher and fronting a public right of way are required by NYC Administrative Code §28-305.4 to hire a NYS licensed professional engineer who is designated by the Department of Buildings as a Qualified Retaining Wall Inspector (QRWI) to inspect the structure at least once every five years and file a report with DOB according to the schedule set out in 1 RCNY §103-09. Cycle 2 ends on December 31, 2023.

Full Demolition to Launch in DOB NOW: Build
Beginning in early 2023, all new Full Demolition (FD) jobs will be required to be filed in DOB NOW: Build. Certain jobs filed in the Buildings Information System (BIS) prior to the DOB NOW launch will be required to be refiled in DOB NOW: Build to continue the job.

NEW Electrical Inspection Request Types
To improve scheduling of electrical inspections, starting January 6, 2023, DOB NOW: Inspections will list new inspection types for electrical jobs.

Development HUB Post Approval Amendments
Effective January 3, 2023, all Post Approval Amendment (PAA) submissions for BIS jobs assigned to the Development Hub require selection of a PAA Review Type in eFiling.

Buildings After Hours Cancelled on December 27, 2022
Buildings After Hours is cancelled on Tuesday, December 27, 2022 at all borough offices. Buildings After Hours will resume on Tuesday, January 3, 2023.

2022 Construction Codes: Revised PW1A Schedule A Occupancy/Use Form
The PW1A: Schedule A-Occupancy/Use form has been updated to include the 2022 Construction Codes.

REMINDER: Concrete Safety Managers, Construction Managers, Superintendents, and Project Managers Should Maintain Best Practices to Prevent Structural Damage to Concrete During Cold Weather Placement
Cold weather concreting practices must be instituted when the average daily air temperature is less than 40° F for more than 3 consecutive days or when the air temperature is 50° F or less for more than 12 hours in any 24-hour period.

Structurally Compromised Building Report Filing Process
Owners of buildings that are potentially structurally compromised are required by Article 217 of the New York City Administrative Code to hire a New York State licensed design professional to inspect the structure within 60 days of the building becoming structurally compromised and file a report with the Department of Buildings within 30 days after the inspection.

Annual Inspections and Tests for Boilers and Elevators Must be Performed by December 31, 2022
High-pressure and low-pressure boilers are required to have annual inspections, and elevators are required to have periodic inspections and Category 1 tests, between January 1 and December 31 each year. The annual inspections, periodic inspections, and Category 1 tests for 2022 must be performed by December 31, 2022.

Follow up #1: Temporary Construction Equipment No Longer Requires a Final Inspection
A TR1 for Final Inspection is no longer required for EQ – Construction Equipment work types in BIS (Chute, Fence, Supported Scaffold, Sidewalk Shed, Support of Excavation, etc.) See Local Law 146 of 2021.

2022 Construction Codes: Fee Changes for BIS Jobs
Beginning Wednesday, November 23, 2022, the following fee changes are effective in the Buildings Information System (BIS).

Follow up #1: Buildings After Hours Cancelled at Brooklyn Borough Office
Buildings After Hours is cancelled on Tuesday, November 22, 2022, at the Brooklyn Borough Office only. Buildings After Hours will take place in all other borough offices from 4:00 to 7:00 pm.

2022 Construction Codes: Revised PW1 Plan/Work Application Form
The PW1: Plan/Work Application form has been updated to include the 2022 Construction Codes. The new form will have the following changes and additions.

Local Law 40 of 2021: Work Disturbing Lead Paint or Paint of Unknown Lead Content
Beginning November 14, 2022, applicants for permits for work that will disturb lead paint or paint of unknown lead content will be required to provide these information.

Articulating Boom Cranes and Telehandlers
The Department of Buildings is currently drafting rules to implement provisions of the 2022 Building Code concerning articulating boom cranes and telehandlers. Until the rules are enacted, the requirements of the 2014 Building Code for articulating boom cranes and telehandlers will continue to be enforced.

Redesigned DOB NOW Includes New Zoning Challenge Tool
On November 7, 2022, DOB NOW will have a new front page with a streamlined layout for easier navigation and better display on mobile devices. The page will include a new Building on My Block/Zoning Challenge tool.

2022 Construction Codes: New Special Inspections; New Required Documents; Fee Changes
Job filings submitted in DOB NOW on or after November 7, 2022, may require new Special Inspections and new Required Documents to comply with the 2022 Construction Codes. In addition, certain fees related to these filings will change.

Beginning Wednesday, November 2, 2022, the Administrative Enforcement Unit will accept walk-in customers at 280 Broadway, 1st Floor for assistance with Certificate of Correction requests that have been submitted online in DOB NOW: BIS Options.

2022 Construction Codes: Construction Superintendent Not Required on 1-, 2- or 3-Family Buildings
The 2022 Construction Codes, which take effect November 7, 2022, provide that new building, enlargement, major alteration (AltCO), and demolition jobs on 1-, 2-, or 3-family buildings do not require a Construction Superintendent (CS) if the permit holder is registered with the NYC Department of Buildings as a General Contractor (GC). DOB will apply this provision to new building, enlargement, major alteration (AltCO), and demolition jobs on 1-, 2-, or 3-family buildings subject to the 2014 Construction Codes.

2022 Construction Codes: Site Safety Requirements for Major Building Site Safety Projects
The site safety requirements in the 2022 Construction Codes will apply to major building* site safety projects that have not submitted site safety plans to the Department of Buildings before November 7, 2022.

Temporary Construction Equipment No Longer Requires a Final Inspection
Beginning November 5, 2022, a Technical Report (TR1) - Final will no longer be required for Sidewalk Shed (SH), Construction Fence (FN), Supported Scaffold (SS) and Protection and Mechanical Means (PMM) work types in DOB NOW: Build. (See Local Law 146 of 2021.) Submission of a notification of removal will sign off the permit and complete the filing.

New Location – Brooklyn Borough Office - Click here to read this notice in your language
On Monday, November 21, 2022, the Brooklyn Borough Office will relocate to 345 Adams Street, 3rd Floor. Records requests for Brooklyn properties cannot be submitted from November 16 to November 17. No in-person plan examination appointments will occur for Brooklyn job filings November 21 through November 23.

Traffic Control During Crawler Crane Activities
The NYC Fire Department (FDNY) and NYC Emergency Management (NYCEM) will no longer be dispatched for traffic control purposes during the set up/take down of a crawler crane, laying down or jackknifing a crawler crane boom or boom/jib combination, implementation of other special protective measures to secure a crawler crane, raising a crawler crane boom or boom/jib combination from a laid down/ jackknifed position, or removing other special protective measures.

DOB to Launch Dedicated Small Business Support Portal
Two enhancements are being made to DOB’s systems on September 14, 2022, to make it easier for small business owners to work with the Department.

Department Launches Major Projects Development Program
On September 12, 2022, new functionality will be added to DOB NOW: Build for the Major Projects Development Program (MPP).

Certified Site Safety Managers and Site Safety Coordinators Can Also Hold a Construction Superintendent Registration
Effective August 14, 2022, certified Site Safety Managers (SSM) and Site Safety Coordinators (SSC) can simultaneously hold a Construction Superintendent registration. A certified SSM/SSC who registers to become a Construction Superintendent before the 2022 NYC Construction Codes go into effect on November 7, 2022, will qualify without having to demonstrate additional qualifying experience. See Title 1 of the Rules of the City of New York (RCNY) Sections 104-08 and 3301-02.

Supersede Owner and Add Owner Email Address Requests for BIS Jobs
A new owner can submit a Post Approval Amendment (PAA) in eFiling without the signature and seal of the Applicant of Record if the only change requested is to supersede the previous owner or add an owner’s email address (Section 26 on the PW1: Plan/Work Application).

Electrical Civil Penalty Calculations and Payments for Failure to file an Application for a Work Permit
Customers are no longer required to make electrical civil penalty payments at the Central cashier office at 280 Broadway. Special Gowanus Mixed Use District: Gowanus Mix Use Incentive
The newly enacted Special Gowanus Mixed Use District in the NYC Zoning Resolution (ZR) contains an as-of-right incentive in Section 139-212 (the “Gowanus Mix Use incentive”). This incentive allows projects in the special district to obtain an increase in the amount of floor area ratio by dedicating floor area on the zoning lot to certain uses, known as Gowanus Mix Uses. ZR 139-212 requires that a Notice of Restrictions (NOR) be recorded against the subject tax lot in the Office of the City Register.

Since January 1, 2022, DOB-approved course providers have issued new Site Safety Training (SST) Cards through the NYC DOB Training Connect Platform, a web-based platform designed to streamline the process of obtaining an SST Card and drastically reduce the likelihood of fraud. All previously issued SST Cards must be replaced by a NYC DOB Training Connect SST Card by January 31, 2023.

NYC Department of Environmental Protection (DEP) Permit Required for Work Disturbing 20,000 Square Feet of Soil
Applicants for work that will result in an amount of soil disturbance greater than or equal to 20,000 square feet, or in the creation of 5,000 square feet or more of impervious surface, are required to submit DEP Stormwater Construction and Stormwater Maintenance Permits. This requirement is not limited to work in an MS4 Area. See Local Law 91 of 2020 and Chapter 19.1 of the Rules of the City of New York.

Periodic Elevator Inspections Must be Performed by Approved Agency on Behalf of Owner

Beginning January 1, 2022, owners are responsible for the required periodic elevator inspections listed in Table N1 of ASME A17.1, as modified by Chapter K1 of Appendix K of the New York City Building Code. The periodic inspection must be performed by an approved elevator agency on behalf of the owner, see Article 304 of Title 28 of the NYC Administrative Code. Inspections will no longer be performed by Private Elevator Agency Directors/Inspectors on behalf of the Department of Buildings.

The Customer Service Atrium at 280 Broadway in Manhattan will be closed Friday, December 3, 2021, for all drop-off and in-person transactions due to office renovations.

Penalties for Failure to File Sprinkler Report
Beginning January 1, 2022, owners who fail to file an acceptable report certifying sprinklers were installed in their building, as required by Local Law 26 of 2004, will be subject to the civil penalties. The filing must be submitted to the Department of Buildings at NYCDOBLL26@buildings.nyc.gov.

New License Requirements for Elevator Work in New York City
Beginning January 1, 2022, elevator work in New York City may only be performed by authorized individuals, that are under the direct and continuing supervision of a licensed Elevator Agency Director. The Department will issue two new Elevator Agency Technician licenses and the Elevator Agency Helper registration to qualified individuals. DOB will begin accepting applications for these licenses and registration on December 11, 2021.

New Periodic Inspection Requirements for NYC Parking Structures

In May of 2020 DOB announced the shift to online training by DOB-approved Course Providers, with the exception of courses that included hands-on training. For courses that include hands-on training, DOB-approved course providers can now deliver the hands-on portion of the training in person and the remaining portion through either a live Virtual Classroom or live Webinar – adhering to DOB’s Actively Proctored Online Training Policy and the applicable accreditation standards of each course provider.

Beginning October 16, 2021, applications for buildings with any of the below designations in the Property Profile will not require submission of a Certificate of No Harassment (CONH) to the Department of Buildings if the work to be performed is the minimum necessary to lift an active vacate order issued by the Department of Housing Preservation and Development (HPD) or DOB, per Section 10-02 of Title 28 of the Rules of the City of New York. These applications must be filed as Standard Plan Examination in DOB NOW.

NEW Requirement for Limited Alteration Application Supersede and Withdrawal Requests

Building Owners Required to Post Building Energy Efficiency Rating Label – Local Law 33 of 2018 as amended by Local Law 95 of 2019
No later than October 31, 2021, owners of buildings over 25,000 square feet – or multiple buildings on a lot that total 100,000 square feet or more – that appear on the NYC Benchmarking Covered Building List for Compliance in 2021 must post the Building Energy Efficiency Rating Label that includes the building’s 2020 energy efficiency grade in a conspicuous location near each public entrance to their buildings.

License Renewal Requirements: Hoisting Machine Operator Class B Endorsements
Hoisting Machine Operators Class B are required to renew their HMO ratings at the same time they renew their license and requalify those ratings during the prior existing term of their license according to 1 RCNY §104-09.

Beginning April 29, 2021, the Department of Buildings will issue violations to owners of buildings over 25,000 square feet – or multiple buildings on a lot that total 100,000 square feet or more – that appear on the NYC Benchmarking Covered Buildings List who fail to post an Energy Efficiency Rating Label as required by Local Law 33 of 2018. Per 1 RCNY 103-06 (l)(2), an owner who fails to post the label within 30 days after October 1 will be subject to a civil penalty of $1,250.

As of Monday, March 22, 2021, all eFiling Authentication Forms are required to be submitted via the DOB Help Form at www.nyc.gov/dobhelp. Also use the help form to submit audit questions, civil penalty review requests, supersede/withdrawal requests and other general inquiries specific to Limited Alteration Applications.

Remote Video Inspections Pilot Program
The Department of Buildings is piloting Remote Video Inspections (RVI) for certain inspection types from March 19 – April 30, 2021 using digital video technology. This voluntary program covers Construction Final Inspections in Staten Island and Rescission of Stop Work Orders issued for Construction Work Without Permit in Brooklyn, replacing the in-person inspections.

Follow-Up #1 – Local Law 160 of 2017: Covered Arrears
Beginning March 1, 2021, as required by Local Law 160 of 2017, the Department will deny New Building and Alteration-CO permits in DOB NOW if $25,000 or more in covered arrears is owed to New York City with respect to the property for which the permit is being sought, or the owners of the property together owe $25,000 or more in covered arrears to the City.

Façade: Failure to Correct Safe With a Repair and Maintenance Program (SWARMP) Civil Penalty
Effective February 21, 2020, a Failure to Correct SWARMP civil penalty applies for Façade Inspection Safety Program (FISP) eligible buildings that are classified as unsafe because the owner failed to correct conditions noted in the previous FISP report filing cycle, as per 1 RCNY §103-04.

Exposed gas piping systems in all buildings, except one- or two-family homes, must be inspected by a Licensed Master Plumber (LMP), or a qualified individual working under the direct and continuing supervision of a LMP, at least once every four years according to the schedule set out in 1 RCNY §103-10. A new bill approved by the City Council on December 17, 2020, and expected to become law on January 18, 2021,extends the inspection deadline for buildings in Community Districts (CD) 1, 3, and 10 in all boroughs from December 31, 2020, to June 30, 2021.

Local Law 191 of 2018: Deadline for Installation of Carbon Monoxide Detectors in Commercial Spaces Extended
Local Law 191 of 2018 requires buildings that are equipped with a fire alarm system and contain Occupancy Group A-1, A-2, A-3, Group B or Group M to install carbon monoxide detectors by January 1, 2021. A new bill approved by the City Council on December 17, 2020, and expected to become law on January 18, 2021, extends the deadline for compliance to July 1, 2021.

COVID-19 Response: Rigging, Scaffold and Concrete Safety Refresher Training Card and Certificates Require Renewal by November 9, 2020

Local Law 114 of 2019: Denial of Permits for False Statements and Work Without a Permit
Beginning August 5, 2020, DOB will deny initial work permits for multiple dwellings where the Department has issued a summons for submitting a false statement on a Plan/Work Application (PW1) regarding the occupancy status of the building (Section 26 of the PW1), or performing Work Without a Permit while the building was occupied. The one-year permit restriction will apply if the summons was issued on or after December 5, 2019 – the effective date of Local Law 114 of 2019. The restriction will remain in effect for one-year from the issuance of the summons. However, the permit restriction can be removed before the one-year timeframe if the summons is dismissed by OATH.

HUB Full-Service and Self-Service Update
Beginning Thursday, July 30, 2020, HUB Full-Service and HUB Self-Service jobs in eFiling will be Administratively Closed if the Applicant of Record has not paid for the initial filing within 90 days of it being assigned a job number.

Property Owners and Other Responsible Parties are Required to Report Construction Site Incidents
To comply with Local Law 78 of 2017, property owners, contractors, subcontractors, or person(s) otherwise in control of a construction site must report details of an incident to the Department of Buildings within three (3) business days using the Injury/Fatality Incident Information Form. Failure to comply with this mandate may result in a $2,500 civil penalty in accordance with § 28-202.1 and §28-103.21.1 of the Administrative Code.

COVID-19 Response: Benchmarking Guidance for August 1, 2020 Deadline
Due to the ongoing COVID-19 public health emergency, property owners who were not able to submit their CY2019 benchmarking information by May 1, 2020 are required to submit a fully compliant report by August 1, 2020.

COVID-19 Response Update: Litigation Papers, Subpoenas and FOIL Requests
As the City reopens, the Department of Buildings (DOB) continues to make safety a priority. In response to the Coronavirus, DOB has limited the amount of walk-in traffic to DOB offices by developing online processes for in-person transactions. Litigation papers, subpoenas and FOIL requests cannot be hand-delivered and must be submitted online until further notice.

The portal will allow the public to search for boiler violations at a property and any amount due for these violations. It will be mandatory to submit in DOB NOW: Safety all payments for Failure to File an annual inspection report for low- and high-pressure boilers and requests to waive civil penalties resulting from these violations.

COVID-19 Stop Work Orders Rescission Portal
Beginning July 8, 2020, construction sites that do not follow COVID-19 safety guidance by failing to have a Safety Plan and/or affirmation posted conspicuously and available for inspection or failing to have at least one hand washing or hand sanitizing facility will be issued a Stop Work Order (SWO). A portal will be available in DOB NOW: Safety to submit SWO Rescind Requests.

REMINDER: Inspect Elevator Controller Mechanical and Electrical Components Specific to the Braking System
Licensed Elevator Agencies are reminded that they are required to inspect the main braking systems, and emergency braking systems, including all electrical and mechanical components used in brake operation, on all automatic passenger and freight elevators during scheduled maintenance in accordance with Appendix K1, Section 8.6.4.6.1, of the 2014 New York City Building Code.

Mandatory Submission of all BIS Job Applications in eFiling to launch June 8, 2020
Beginning Monday, June 8, 2020, all BIS job applications must be submitted in eFiling, except the project/work types or additional considerations listed below. In addition, it will be required to electronically submit initial permits and withdrawal applications in eFiling. Online web-based training sessions will be held beginning May 29, 2020 to guide users through the new procedures.

The Department’s Façade Inspection and Safety Program (FISP) is offering an amnesty period to begin July 1, 2020. The program will run for three months and may be extended at the Department’s discretion. The amnesty program is only open to non-compliant Cycle 8 owners.

2020 NYC Energy Conservation Code in Effect

COVID-19 Response: Certificate of Authorization, License and Permit Renewal Extension
All licenses/registrations and permits issued by the Department of Buildings and expiring from the beginning of the declaration of the state of emergency through the period of the emergency declaration are extended in accordance with Mayoral Emergency Executive Order. Currently, this period has been extended to June 7, 2020. Approved sites need to post a new Certificate of Authorization with the expiration date of June 7, 2020.

COVID-19 Response: Place of Assembly Applications Resume
As of Wednesday, May 6, 2020, applications for Place of Assembly and Place of Assembly Certificates of Operation can be submitted and will be reviewed in DOB NOW: Build. Temporary Place of Assembly applications remain suspended for the duration of the state of emergency.

Beginning Monday, April 27, 2020, Certificate of Occupancy, Letter of Completion and Temporary Certificate of Occupancy Folder Review Requests (PW7) cannot be submitted in-person to a borough office and are required to be submitted in eFiling. Hub Self-Service will now accept submissions of PW1 Plan/Work Applications. In addition, eFiling has been updated for Development Hub Jobs to categorize PW1 Plan/Work Application submissions as initial or subsequent filings.

Crane Filings Launch in DOB NOW: Build, Updated Essential Construction Questionnaire for Electrical and Limited Alteration Applications and Certificates of Correction Mail Submission Deadline
Crane filings (phase one) will launch in DOB NOW: Build on Monday, April 27, 2020. The Essential Construction Questionnaire in the permit application for Electrical and Limited Alteration Applications has been updated to include the revised guidelines in the DOB Guidance Document. The deadline to submit Certificate of Correction requests by mail is May 1, 2020.

Due to the ongoing COVID-19 public health emergency, building owners who are not able to submit their CY2019 benchmarking information by May 1, 2020 will not be issued a violation for non-compliance if they submit a fully compliant report by August 1, 2020. In addition, payments for benchmarking violations are required to be submitted in eFiling.

COVID-19 Response: Enhancements to Post Approval Amendment and Correction Submissions in eFiling and Essential Construction Requests Update for Electrical and Limited Alteration Applications Permits and Demolition Filings
The process for submitting Post Approval Amendment applications and correction requests in eFiling has been enhanced. In addition, the Essential Construction requests portal at www.nyc.gov/dobnow has been updated to allow for submission of Electrical and Limited Alteration Application (LAA) permits that were submitted prior to April 3, 2020 and Demolition filings. Periodic Parking Garage Inspections
New York State recently enacted requirements for the periodic inspection of parking garages. An initial condition assessment is required prior to a certificate of occupancy or certificate of compliance being issued for a new structure. Existing buildings must complete an initial condition assessment prior to October 1,2019, October 1, 2020, or October 1, 2021, depending on the date of original construction. Following the initial condition assessment of a parking garage, such parking garage shall undergo periodic condition assessments every three years.

Filing Requirements for Applications Requiring Final Inspection by Registered Design Professional
Applications for most work types are required to have the final inspection performed by a Registered Architect or Professional Engineer (Registered Design Professional or ‘RDP’). For more information, see Buildings Bulletin 2018-008.

Refund Requests for Superseded Limited Alteration Applications (LAA)
Effective immediately, there will be no refunds issued for Superseded (LAA) filings. If the initial licensed contractor (License Master Plumber, Fire Suppression Contractor or Oil Burner Equipment Installer) is replaced on a LAA and a new licensed contractor takes responsibility for the work being performed, the filing fees paid by the initial licensed professional will remain with the application and will not be refunded.

Effective January 1, 2020 all automatic passenger and freight elevators must be in compliance with the retroactive requirements found in Appendix K Chapter K3 Section 3.10.12 of the New York City Building Code.

Beginning August 15, 2019, applicants in the Buildings Information System (BIS) for New Buildings (NB), Demolition (DM), and Alteration Types 1 and 2 (Alt1 and Alt2) with horizontal enlargements will be required to answer two additional questions on the PW1, and may be required to submit a Stormwater Construction Permit from the NYC Department of Environmental Protection (DEP).

Follow up #1 – Local Law 28 of 2019: Temporary Assistance for Certain Accessory Signs
From August 7, 2019, through February 9, 2020, the Department will waive 75% of the filing fees for sign permits for respondents who received a DOB sign violation. Learn more.

Follow-up #7: Elevator Compliance Filings
The deadline for paper re-submissions has ended. Effective July 1, 2019 'rejected' Elevator Inspection/Reports (ELV3) and Affirmation of Correction (ELV29) filings for 2018 and prior year reporting cycles will no longer be accepted.

Local Law 49 of 2019: Pilot Program for Alteration of Basement and Cellar Apartments in Certain Areas of Brooklyn CD 5
Beginning July 2, 2019, the Department of Buildings will accept applications for the creation and alteration of basement and cellar apartments in the program area of East New York and Cypress Hills, Brooklyn (Community District 5 with certain exclusions).

Periodic Parking Garage Inspections

Local Law 196 Reminders and Updates
Local Law 196 of 2017 requires workers at job sites that must designate a Construction Superintendent, Site Safety Coordinator or Site Safety Manager to receive 30 hours of site safety training by December 1, 2019 and an additional 10 hours of training by September 1, 2020. Supervisors will need 62 hours of training by the December 1, 2019 deadline.

Local Law 97 of 2017: Stormwater Construction Permit
Beginning June 1, 2019, a Stormwater Construction Permit from the NYC Department of Environmental Protection (DEP) must be obtained for development projects.

Gas Test and Gas Finish Self-Certifications Ending in Queens and the Bronx
Effective July 12, 2019 Gas Test and Gas Finish self-certifications will no longer be allowed for work done in the Bronx and Queens. A physical inspection witnessed by the Department of Buildings will be required. All inspections must be requested using DOB NOW: Inspections.

Change to Plan Exam Appointment Length
Beginning June 14, 2019, the length of appointments for Alteration Type 1 (Alt1) jobs scheduled through DOB Appointments will be reduced from 40 minutes to 20 minutes. The new shortened appointment time is designed to improve the efficiency of the appointment system and increase plan examiner availability. This change will not affect any appointments made prior to the June 14 date.

Mechanical Systems and Structural Filings to Launch in DOB NOW: Build as well as the Plumbing, Sprinkler and Standpipe Filings will be Mandated
Effective July 1, 2019, all new applications for the Mechanical Systems (MS), Structural (ST), Plumbing (PL)/Sprinkler (SP)/Standpipe (SD) work types will be mandatory to submit in DOB NOW: Build at www.nyc.gov/dobnow.

Follow-up #2: HPD CONH Pilot Program Update Prohibition on Professionally Certified Filings New HPD4 Form - (Supersedes Follow-up #1)
Beginning May 30, 2019, the Department will not accept professionally certified filings for Demolition (DM) or Alteration Types 1, 2, and 3 jobs for buildings on the HPD Pilot Program list. These applications must be filed as standard plan examination.

Local Law 195 of 2018: Fire Alarm Systems, Fire Suppression Systems, and Fire Protection Plans to be Submitted to the Fire Department ONLY
Effective June 2, 2019, Fire Alarm (FA), Fire Suppression (FP), and Fire Protection Plan (FPP) work types will no longer be filed with the Department of Buildings. Applicants must file these work types with The Fire Department (FDNY) and pay the filing fees to FDNY.

Civil Penalties to Double for Multiple Work Without a Permit Violations
Beginning May 30, 2019, any building that received a work without a permit violation on or after August 28, 2018 (the effective date of Local Law 158), will be subject to doubling of the civil penalties for a second or subsequent work without a permit violation within one year of the most recent violation.

Local Law 158 of 2017: Restriction on Professionally Certified Filings
Beginning May 30, 2019, the Department of Buildings will restrict professionally certified filings on all buildings with a work without a permit civil penalty imposed on or after August 28, 2018 (the effective date of Local Law 158). These buildings will be flagged in the Buildings Information System (BIS) Property Profile as "LL158/17 Pro Cert Restriction." If there is an "until" date in the flag, applications for plan approval must be filed as standard plan examination.

Instructions to Remedy a Notice of Violation for Failure to File an Elevator Inspection and Test Report are Available
A current inspection and test report is required to remedy violations received for failure to file mandatory Category 1 and Category 5 periodic elevator inspection and test reports.

Local Law 196 Reminders and Updates
Local Law 196 of 2017 requires workers at job sites requiring a Site Safety Plan (which includes sites that must designate a Construction Superintendent, Site Safety Coordinator or Site Safety Manager) to receive 30 hours of site safety training by June 1, 2019 and an additional 10 hours of training by September 1, 2020. Supervisors will need 62 hours of training by the June 1, 2019 deadline. REQUIREMENT: Property Owners and Other Responsible Parties Must Report Construction Site Incidents
To comply with Local Law 78 of 2017, the property owner, contractor, subcontractor, or person otherwise in control of a construction site must use the Injury/Fatality Incident Information Form to report details of the incident within three (3) business days to the Department of Buildings. Failure to comply with this mandate may result in a $2,500 civil penalty in accordance with § 28-202.1 and §28-103.21.1 of the Administrative Code.

AEU3321 Form Updated
Effective April 1, 2019, the Administrative Enforcement Unit (AEU) will no longer accept the AEU3321 form dated '11/18.' Only the new form with the '3/19' revision date will be accepted.

Cranes & Derricks Forms Updated
Effective March 1, 2019 applicants filing new crane notifications (CN) must use the revised CD8, CD8-TR, and CD8-AD forms when documenting the inspections and tests performed for a Certificate of On-Site Inspection and submitting to the Cranes and Derricks Unit, pursuant to rule amendments contained in 1 RCNY 3319-01. CN filings prior to March 1, 2019 are permitted to use the current versions of the CD8 and CD6 forms, and will not be required to file the revised forms.


Updated L2 Form: Updated Form to Include Additional Waiver Request Information
Beginning March 25, 2019, the L2 Form with the revised date of 06/18 in the lower right corner will no longer be accepted. Applicants or property owners must submit the updated L2: Work Without a Permit, Requesting an Override, Reduction or Waiver of Civil Penalties form with the revised date of 02/19 when requesting an override, reduction or waiver of civil penalties for work without a permit.

Local Law 28 of 2019: Penalties and Violations for Certain Accessory Signs
As of February 9, 2019, the Department will not impose civil penalties for work without a permit violations for business storefront signs that neither exceed 150 square feet in area nor exceed 1,200 pounds in weight.

2018 Benchmarking Compliance Deadline Extended
The 2018 Benchmarking compliance deadline for the 2017 calendar year has been extended. The 2017 calendar year data is now due no later than February 15, 2019.

REQUIREMENT: Use Construction Safety Compliance Forms
Effective February 11, 2019, all BEST Squad forms have been replaced with new Construction Safety Compliance (CSC) forms. In addition, applicants are required to use the CSC Appointment Request Form for: pre-demolition inspection, demolition sign-off, Site Safety Manager/Coordinator Program removal, sidewalk shed removal, and suspended scaffold pre-use inspection.

Follow-up #1: HPD Pilot Program Update - Superseded by Follow-up #2
Per Local Law 1 of 2018, applicants submitting for plan approval, Post Approval Amendments (PAA), work permits for demolition (DM) or Alteration Types 1, 2, and 3 (Alt1, Alt2, Alt3) for an address flagged as a HPD Pilot Program building will be required to submit certain documentation to the Department to obtain plan approval or a work permit for covered categories of work.

Event Recorder Required for Cranes
Effective January 1, 2019, no crane shall be issued or have renewed a certificate of operation unless the crane is equipped with an event recorder, pursuant to Local Law 79 of 2017. The event recorder must be installed to collect: the crane configuration, overload conditions, the status of limit switches, and operator overrides.

Plumbing, Fire Suppression & Electrical License Boards: Accepting Applications for Members
The Department is seeking electrical and plumbing experts to serve on the 2019 Master Plumbers & Master Fire Suppression Piping Contractors License Board, the 2019 Master and Special Electrician License Board, and the Plumbing Operations Committees. The application deadline to be considered for participation is February 8, 2019.

Crane Age Limitation
Effective January 1, 2019, only cranes having an age of less than 25 years from the manufacture date may be used in New York City, pursuant to Local Law 3 of 2018.

New Construction Safety Units
The BEST Squad, Excavation/Interior Demolition and Scaffold Safety Units have been reorganized and two new units were created, the Construction Safety Enforcement Unit (CSE) and Construction Safety Compliance Unit (CSC). Local Law 87/09: Process to Comply for New Buildings and Buildings Undergoing Alterations
Local Law 87/09 requires owners of applicable, mixed-use and residential buildings to submit an Energy Efficiency Report (EER) once every ten years. Owners must submit their EER in the calendar year coinciding with the last digit of the building’s tax block number.

To make inspection requests, delegate others, and view results, the email address used to register for your DOB NOW: Inspections account must match the email address listed in Section 26 of the Plan Work Application (PW1) or Section 6 of the Place of Assembly Application (PA1). If you are an owner and you need to correct the email address you provided, the applicant (PE/RA) is not required to sign and seal the form. NEW Electrical Advisory Board Submission Requirement: Asbestos Abatement Compliance Required
Effective May 1, 2017, all submittals for Electrical Advisory Board (EAB) review and approval (1,000 KVA or greater) must include one of the following, dependent upon the presence of asbestos containing material (ACM) at the project.

Cash Payment Restrictions
Effective April 10, 2017, the New York City Department of Buildings will limit cash payments to a maximum of $50.00 per transaction. Additionally, the Department will not accept cash payments for civil penalties or returned checks (A.K.A. ‘No Good Checks’).

eRenewal Requirement Updates
The Department has updated the requirements for eRenewal. These updates impact eRenewals of permits where the Construction Superintendent (CS), Site Safety Coordinator (SSC), or the Site Safety Manager (SSM) have changed or where their licenses are inactive or expired.

Development HUB Consultation Request Form Updated
Effective March 2017, an updated electronic Consultation Request Form, issued by the Development HUB will be released. The updated form will improve the project eligibility review process and collect additional data to better serve the public.

LAA Filings: Fire Stopping Requirements
With the new change, in all instances where the fire stopping has been restored, the License Master Plumber or Licensed Master Fire Suppression Contractor must upload into DOB NOW: Inspections a signed and sealed statement on company letterhead with the following information at the time of request for LAA sign-off.

New York City Construction Codes Revision Committee: Accepting Applications for Members
The Department is seeking applicants to serve on the 2017 Construction Codes Revision & Development Committee. To be considered for committee membership, a completed application must be submitted, including all required documentation, to the Department by March 30, 2017.

Continued Enforcement of Active Job Designations for Registered Construction Superintendents
In compliance with the NYC Department of Buildings’ regulations, Registered Construction Superintendents (CS) cannot be designated on more than 10 active jobs. The Department will audit filings to enforce this mandate and in the future, the Department will be adding a hard stop, automatically preventing filings from proceeding if CS is on more than 10 active jobs.

Temporary Heat in Buildings Under Construction
To provide temporary heat for buildings under construction during the heat season – October 1 through April 30 – Plumbing Contractors may install salamanders by either connecting to cooking gas risers, temporary risers or by using the boiler in the building. As required, all Temporary Heat applications must be completed with a Department inspection or self-certification.

LAA Emergency Work Notification Process for Utility Company Gas Restoration
As of November 22, 2016, all Licensees filing for an Emergency Work Notification (EWN) for gas restoration from the utility company must send the EWN request to the LAA unit at DOBEWN@buildings.nyc.gov in order to receive an immediate receipt. This process should ONLY be used for notifications related to GAS EMERGENCY CONDITIONS.

Manhattan Gas Emergency Work Notification
Effective Tuesday, November 22, 2016, Gas Test and Gas Finish self-certifications will no longer be allowed for work done in Manhattan. A physical inspection by the Department of Buildings will now be required. This will also apply for all emergency work requiring Gas Finish inspections in Manhattan. All other emergency work will continue to be accepted as a self-certification in DOB NOW: Inspections.

Changes to Elevator Door Monitoring System - Permit and Inspection
As per ASME A17.3 of 2002, as modified by Chapter K3 of Appendix K Section 3.10.12 of the New York City Building Code, all automatic passenger and freight elevators must provide a system to monitor and prevent automatic operation with faulty door contact circuits by January 1, 2020.

Gas Test and Gas Finish Self-Certifications Ending in Manhattan
Effective Tuesday, November 22, 2016 at 8:00am, Gas Test and Gas Finish self-certifications will no longer be allowed for work done in Manhattan, a physical inspection witnessed by the Department of Buildings will be required.

Counter Service Protocol
All customers, who possess a DOB-issued ID card, are being reminded to be fully prepared before obtaining a service ticket at the kiosk. Beginning November 7, 2016 all DOB-issued ID card customers who appear at the service window unprepared, will be marked as such and may be subject to disciplinary action.

Local Law 56 of 2016: Permit Fees for New Buildings and Alterations Updated
The Department is re-programing its systems to implement new fee changes specified in Local Law 56 of 2016, effective June 9, 2016. Permit fees will continue being calculated for new buildings (NB) and alterations using old rates until system updates are completed.

Revision to the Construction Superintendent Rule Includes Expanded Scope of Work and Duties
The duties and jobs types requiring a Construction Superintendent (CS) have been expanded in the recently published Rule 3301-02. The changes occur in two phases. General Liability Insurance Required for Shed and Scaffold Job Types

General Liability Insurance Form Update (PGL1)

Filing Representative: 3-Year Registration Term
Effective May 1, 2016, the Department will begin transitioning all Filing Representative Registrations from a one (1) year term to a three (3) year term. This will impact new applicants and currently registered Filing Representatives. As a result, the renewal and issuance fees will increase to reflect the three (3) year term.

Elevators: Weekend Inspection Blitz
Throughout April, the Elevator Inspectorial staff will be available during weekends to perform full test inspections on new or replaced elevators. To reserve a weekend test, submit a request for inspection in Inspection Ready and make the expedited test inspection payment with the 4th floor cashier at 280 Broadway.

Inspection Ready: Bulk Delegation Owners, Applicants and Permit Holders Can Now Delegate Multiple Users Simultaneously
The Inspection Ready Delegation feature allows Owners, Job Applicants and Permit Holders to designate rights to other people, such as Filing Representatives, to take certain actions. Only registered Inspection Ready account users are eligible to become Delegates. Individuals who wish to become Delegates but have not registered, should follow the registration instructions in the Account Registration and Management user manual.

Requesting Records from Off-Site Storage: New Hold Policy
In an effort to standardize record retention policies and improve the tracking of Department records, all records requested from off-site storage will be held in the Records Unit for a maximum of 15 business days, effective immediately.

Solar Photovoltaic (PV) Panel Installation Projects Sloped Roof Definition Update
Effective January 1, 2016, most small-scale Solar PV Panel Installation projects filing for Tax Abatement have become eligible for Professional Certification through Hub Self Service.

Installation of Drywells for Storm Water Disposal: Advance Notice and Inspection No Longer Required
Effective immediately, the Department no longer requires advance notification of a drywell installation. Additionally, the required Department inspections and spot checks done during an installation are no longer required. All other installation requirements remain.

Local Law 84/2009: Issuance of Department of Buildings (DOB) Violations for Non-Compliance
Owners are required to perform annual analyses of a property’s total energy use on specific building types in New York City. The benchmarking reports must be submitted electronically by May 1 each year. These requirements are outlined in NYC Administrative Code §28-309.4.

Immediately Hazardous (Class 1) Civil Penalty Violations: New Payment Method
Beginning March 14, 2016, the Department will accept payments by credit card for Immediately Hazardous (Class 1) civil penalty violations. These civil penalties are pursuant to the New York City Administrative Code §28-219.1.

NYC Energy Conservation Code (NYCECC): Issuance of Department of Buildings Violations (returnable to the Environmental Control Board - ECB) and Stop Work Orders for Energy Code Infractions
Beginning March 2016, the Department of Buildings (DOB) will issue DOB Violations (returnable to the ECB) and Stop Work Orders for Energy Code Infractions.

Limited Alteration Application (LAA): Intent to Revoke and Revoke Notifications
Effective March 21 2016, an Intent to Revoke or Revoke banner – in addition to the 'Open Issues’ banner – will now be visible in BIS on a Limited Alteration Application when the scope of work is considered non-code compliant, hazardous or egregious.

Demolition Submittal Document Requirements: Exemption from Plan Submission
The Department will no longer accept plan submissions for sites that are exempt from plan submission under the current Code. The exemptions are for plan submissions and not exemptions from the need to file a demolition application (DM).

Lifting Advance Notice Failed Spot Check Conditions
The Department’s Plumbing Enforcement Unit is responsible for conducting field spot checks of professionally certified Plumbing and Fire Suppression work types. When these spot check inspections fail, the Licensee is no longer able to submit professional certifications for that particular job. All tests/inspections associated with the failed spot check will automatically be resulted as failed.

Determination Review Requests: CCD1 and ZRD1 Forms Updated
CCD1 and ZRD1 forms have been updated to improve our review process. The updated forms require submittal of additional information so Determination Requests can be completed more quickly.

eFiling: New Enrollment Process for Professional Engineers and Registered Architects
Effective February 1, 2016, all Design Professionals (including individuals that hold an additional professional license and/or tracking number) must submit their Authentication/Enrollment Form for eFiling enrollment to the Limited Alteration Application (LAA)/Permit Renewal and Hub Authentication Unit in person or by mail.

Inspection Ready: Owner PW1 Email Updates
As an owner, your jobs and permits will be linked to you based on the information in Section 6 of the Place of Assembly Application (PA1) or Section 26 of the Plan Work Applications (PW1). To make inspection requests and view results, the email address used to register for Inspection Ready must match the “Email Address” field in this section on the initial PW1 filed with the application. This is a requirement and owners should verify this information before signing, approving, and submitting these documents to the Department.

Tenant Protection Plans: Available on BISWeb
Effective January 25, 2016, a stand-alone Tenant Protection Plan document must be submitted for all buildings being altered or demolished, containing one or more dwelling units that will remain occupied during construction.

New Crane Rule in Effect: CD1 Form Revised
Effective January 1, 2016, RS 19-2 has been repealed and replaced by Rule 3319-01. The new rule applies cranes, derricks, and dedicated pile drivers that operate within New York City.

Lower Manhattan Construction + Truck Embargo - July 9, 2015 – July 10, 2015
In preparation of this year’s U.S.A Women’s Soccer Ticker Tape Parade, a Department of Buildings and Department of Transportation Special Event Construction Embargo will be in effect in areas throughout Lower Manhattan. Restrictions begin at 10pm on Thursday, July 9, 2015 and remain in effect through 5pm on Friday, July 10, 2015.

Site Safety Plan (SSP) Submission/Façade Alteration: New Filing Option for Professional Applicants
Professional applicants now have the option to file a Site Safety Plan (SSP) for typical façade alterations (restorations) as a professionally certified Alteration Type 3 (A3). Non-professional applicants will continue to submit filings to the BEST Squad for review.

Façade Inspection and Safety Program Extended! Cycle 8 Early Filing Amnesty Program for Non-Compliant Owners
In the interest of public safety, the Department of Buildings is offering an Amnesty Program to owners who failed to file (No Report filed - NRF) a Façade Inspection Safety Report (FISP) during Cycle 7. The FISP Cycle 7 reporting period ended on February 20, 2015.

Customer Service Counter Hours
Effective immediately, the new hours of operation for customers who require tickets for the Construction, Electrical and Plumbing Units.

Retaining Walls: Inspection and Reporting Requirements
RCNY §103-09 and Local Law 37/08, effective January 1, 2014, requires owners of properties with a retaining wall or part of a retaining wall which is at least ten feet high and faces a public right of way such as a sidewalk or entrance must have a condition assessment of this wall conducted every five years and the assessment report submitted to the Department of Buildings by a licensed engineer who has a minimum of three years relevant experience.

Hazardous Formwork: Visual Observations
In addition to the inspections required by the contractor pursuant to BC 3305.3.3.1, a qualified observer shall perform visual observations of the formwork to validate general conformance with the design intent.

Limited Alteration Application (LAA): Renewals with the same BIS Number
Effective June 1, 2015, LAA/Permit Renewal and Hub Authentication Unit will now offer LAA Renewals with the same BIS number and a standard renewal fee of $100.00.

After-Hours Inspection: First Phase
Effective June 1, 2015, the Department of Buildings will launch an after-hour inspection initiative for development projects enrolled in the High Rise Program.

Additional Exit Stairway/Occupant Evacuation Elevator (OEE) Requirements
Under the 2014 NYC Construction Codes, new requirements for additional exit stairway/ occupant evacuation elevators (OEE) in all new non-residential buildings greater than 420 feet in height go into effect for applications filed beginning July 1, 2015. For more information see 2014 NYC Building Code §403.5.2.

Electrical Advisory Board: Submission Process
Applications for electrical installation of 1,000 KVA and above and requests for special permission and new material approvals can be dropped off daily at The Electrical Advisory Board, located at 1 Centre Street in Lower Manhattan from 8:30 am to 4:30 pm.

Special Inspection Agency Registration Renewals
Special Inspection Agency Registration Renewals begin May 13, 2015. The term of the special inspection agency registration is three years. Renewals begin on your birthday following the date of your initial registration.

Scaffold Safety: Site Safety Inspections for Façade Alterations
Effective March 2015, the Scaffold Safety Team will conduct routine safety inspections for façade alterations requiring site safety compliance. The BEST Squad is no longer responsible for conducting these inspections.

Flood-Resistant Construction: Raising or Moving a Building Under LL 29/13
New regulations are in effect for raising, lifting, elevating or moving buildings. This includes specific, required documents under Buildings Bulletin 2013-013 and Special Inspections requirements.

2014 NYC Construction Codes + RCNY: Façades
Façade projects requiring site safety plans – buildings 15 stories and higher – may now use a site safety manager, rigger, designated rigging foreman or qualified person to oversee site safety. See NYC Building Code §§3310, 3314.4 and 3316.9, and 1 RCNY 3310-01.

2014 NYC Construction Codes: Notification of Suspended Scaffold Installation + Removal

2014 NYC Construction Codes: Exemptions – APPN 1/93 Superseded
On December 31, 2014, Administrative Policy and Procedures Notice (APPN) 1/93 will be superseded by Operational Bulletin 2014-027.

Elevator Inspections: Affirmation of Correction Report Deadline Extended
The deadline to file 2013 Affirmation of Correction reports has been extended to December 31, 2014. This extension applies to reports for unsatisfactory Category 1 inspections for the Calendar Year 2013 inspection cycle.

2014 Construction Codes: Limited Alteration Application Changes
The Limited Alteration Application/Permit Renewal Unit is leading a seminar regarding changes to the LAA form and filing process under the 2014 NYC Construction Codes, which go into effect on December 31, 2014. This seminar will focus on 2014 NYC Administrative Code §28-101.5.

PW1B Forms and Plans: Filings and Amendments
